In 2021, Delta 8 THC laws are a bit unclear everywhere. As of recently, Texas was considering Texas House Bill 2593 that would have made Delta 8 THC a scheduled substance, but the bill was stricken down! Here’s everything you need to know about the current Delta 8 THC laws, and the rules for the Texas Hemp Convention coming to Dallas, Texas this November.
Texas House Bill 2593 & D8’s Current Standing
The Federal Government recognized Hemp (and Hemp Derived Cannabinoids) as a legal crop in 2018 with the passing of the Farm Bill. As of now, it seems that products containing hemp derived Delta 8 THC fits within the farm bills standards as long as it doesn’t contain over .3% Delta 9 THC.. But some states have passed bills excluding Delta 8 THC from the farm bills definition!
Texas House Bill 2593 was in the Texas legislature June of 2021, and if passed would have ruled Delta 8 illegal to purchase or sell. Fortunately the bill was struck down during the Texas Legislation on the week of 5/31, as the author’s could not come to an agreement in time.
Currently there’s 15 States that have explicitly banned D8 / D10 products including; Alaska, Arizona, Arkansas, Colorado, Delaware, Kentucky, Idaho, Iowa, Mississippi, Montana, New York, Rhode Island, Utah, Vermont, and Washington.
If your not located in one of these states, then your in luck! For the time being it doesn’t seem there’s any laws prohibiting the buying and selling of Delta 8 products along with other federally legal hemp derived cannabinoids. But things can change fast, so make sure to check your local laws and regulations before making a sale or purchase.
Delta 8 Rules For #THC2021
The Texas Hemp Convention will be following all federal and state laws! All products advertised on kush.com and at the Texas Hemp Convention must be federally legal and only contain ‘hemp derived cannabinoids’ with a D9 THC result below .3%. States can differ and exhibitors will be from all around the country, so make sure to look into your local laws & regulations before making any sales or purchases.
In short: If Delta 8 is legal in Texas (it is), then it will be allowed at the Texas Hemp Convention!
