Texas House Bill 2593, ‘Temporary Injunctions’, & D8’s Current Standing

The Federal Government recognized Hemp (and Hemp Derived Cannabinoids) as a legal crop in 2018 with the passing of the Farm Bill. As of now, it seems that products containing hemp derived Delta 8 THC fits within the farm bills standards as long as it doesn’t contain over .3% Delta 9 THC.. But some states have passed bills excluding Delta 8 THC from the farm bills definition!

Texas House Bill 2593 was in the Texas legislature June of 2021, and if passed would have ruled Delta 8 illegal to purchase or sell. Fortunately the bill was struck down during the Texas Legislation on the week of 5/31. More recently as of October, there’s been a series of hearings after the Texas Department of State Health Services did issue a statement claiming Delta 8 was a schedule one drug. State district court Judge Jan Soifer on Monday (11/8/2021) granted a temporary injunction against the state to ensure selling or obtaining delta-8 is not a felony offense, making it legal in Texas for the time being. The Texas Hemp Convention will be following all federal and state laws!
